Welcome to DriveShareGo ("Platform," "we," "us," or "our"). DriveShareGo is an online marketplace operating in Jamaica that connects Vehicle Owners ("Hosts") with Drivers ("Renters") for the purpose of vehicle sharing.

By accessing or using our Platform, you agree to comply with these Terms, the laws of Jamaica, and any regulations set forth by the Transport Authority of Jamaica and the Ministry of Science, Energy, Telecommunications and Transport.

"Host" – The registered owner of a motor vehicle listed on DriveShareGo.

"Renter" – The individual who books a vehicle for a specified period.

"Trip" – The duration between vehicle handover and return.

"Transport Authority" – The government body responsible for licensing public passenger vehicles in Jamaica.

To use DriveShareGo, you must meet the following criteria:

• Age: You must be at least 18 years of age (Hosts and Renters), unless otherwise specified.
• License: You must possess a valid Jamaican Driver's Licence or a valid International Driving Permit recognized in Jamaica.
• Legal Status: You must not be prohibited from entering into contracts under Jamaican law.
• Driving Record: Renters must have no major traffic violations (e.g., Driving Under the Influence, reckless driving) within the last 3 years.

This section is critical for operating legally in Jamaica.

4.1 Host Obligations (Licensing)

As a Host, you represent and warrant that:

• You have registered your vehicle with the Transport Authority of Jamaica if required for commercial vehicle sharing.
• You possess the appropriate Road Licence for the intended use of the vehicle.
• You consent to the sharing of your particulars with the Transport Authority for vetting purposes, as mandated by the Government's security protocols.

4.2 Driver Vetting

DriveShareGo reserves the right to:

• Conduct background checks through the Jamaica Constabulary Force (JCF) or approved agencies.
• Deny registration to any driver who fails the security and safety vetting process established by the Ministry of Transport.

4.3 Illegal Use

The vehicle must not be used for:

• Unlicensed "route taxi" or "robot" taxi operations.
• Transporting goods without proper authorization.
• Any activity violating the Road Traffic Act of Jamaica.

This is the most important section. Please read carefully.

Under the Motor Vehicle Insurance (Third-Party Risks) Act of Jamaica, it is a criminal offense to drive a vehicle without at least Third-Party Insurance.

5.1 Host Insurance Requirements

• Hosts must maintain their own insurance policy (Third Party, Third Party Fire & Theft, or Comprehensive) with a licensed Jamaican insurer (e.g., General Accident, GK General, JN General).
• Warning: Most personal auto insurance policies in Jamaica exclude commercial activities or "car sharing." Hosts must notify their insurer that the vehicle will be listed on DriveShareGo. Failure to do so may void the Host's personal policy.

5.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• DriveShareGo is not responsible for lost personal items left in vehicles.
• DriveShareGo is not liable for indirect, incidental, or consequential damages (e.g., lost wages, missed flights) arising from trip delays, cancellations, or vehicle issues.

5.3 Renter Responsibility

• Renters are responsible for the insurance Excess (Deductible) as defined in the policy schedule.
• If a Renter causes an accident and the Host's personal insurance premiums increase, the Renter may be liable for the difference in premium costs for up to 3 years.

• Rental Rates: Hosts set their own hourly/daily rates. DriveShareGo may add a deposit or security fee.
• Payment: Full payment is due at time of booking. Payments are processed via a third-party processor.
• Late Returns: A late fee will be calculated by Host. Failure to communicate with the host may result in the vehicle being reported as stolen.
• Tolls and Tickets: Renters are fully responsible for tolls (Tacoma, Highway 2000, etc.), parking tickets, and speeding fines issued by the Island Traffic Authority.

Cancellation policies are determined by the Host and disclosed on each Listing page. Renters should review these before confirming a Booking.

If a Host cancels a confirmed Booking without reasonable cause, we may apply penalties including temporary suspension of their account and listing privileges.

Refund disputes must be submitted to DriveShareGo within 7 days of the cancellation date.

• Fuel Policy: "Full-to-Full" is standard. The vehicle must be returned with the same fuel level as at pickup. Renters will be charged the cost of fuel + JMD $1,500 service fee for refuelling.
• Cleaning: The vehicle must be returned in reasonably clean condition. Excessive mud, sand (from beaches like Hellshire or Boston Bay), or smoke odor will incur a cleaning fee of JMD $5,000.
• Late Return: A late fee of JMD $2,500 per hour applies. If the vehicle is more than 3 hours late without communication, DriveShareGo reserves the right to report the vehicle as stolen to the JCF.

The vehicle may not be used for:

1. Public Transportation: Operating as a taxi, robot, or ride-share service (Uber, inDrive) unless specifically covered by a commercial policy.
2. Carrying contraband: Including but not limited to illegal drugs, Ganja (except medical with documentation), or uncustomed goods.
3. Off-road: Driving on unpaved roads that risk damage (e.g., Cockpit Country trails without 4x4 authorization).
4. Traffic Violations: Use of the vehicle in a manner that breaches the Road Traffic Act (2018).

In the event of an accident:

1. Stop immediately. Do not leave the scene (Hit and run carries severe penalties in Jamaica).
2. Call the Police (119). An accident report is required for any insurance claim in Jamaica.
3. Exchange Information with the third party (Name, License, Plate number, Insurance details).
4. Report to DriveShareGo via the in-app chat within 2 hours.
5. Do not authorize repairs. The vehicle must be inspected by an assessor from the relevant insurance company.
6. Do not offer to settle the matter "cash on the spot" without a police report, as this voids insurance coverage.

DriveShareGo is committed to protecting your personal data in compliance with Jamaica's Data Protection Act, 2020.

• Data Collection: We collect names, driver's license details, vehicle registration.
• Data Sharing: We may share your data with the Transport Authority, JCF, and Insurance Companies for the purposes of vetting, accident investigation, and fraud prevention.
• Your Rights: You have the right to request access to your data, rectification of errors, and erasure (subject to legal retention requirements). Contact our Data Protection Officer (DPO) at drivesharego@outlook.com.

You agree to indemnify and hold harmless DriveShareGo, its affiliates, officers, and employees from any claims, damages, or expenses (including legal fees) arising from:

• Your breach of these Terms.
• Your use of a vehicle in violation of law.
• Any accident or damage caused by your negligence.

• Consumer Protection: You have the right to lodge a complaint with the Consumer Affairs Commission (CAC) of Jamaica regarding service issues.
• Arbitration: Any legal dispute arising from these Terms shall first be submitted to mediation at the Dispute Resolution Foundation in Kingston before proceeding to court.
• Governing Law: These Terms are governed exclusively by the laws of Jamaica.

To the maximum extent permitted by Jamaican law, DriveShareGo is not liable for:

• Loss of personal belongings left in vehicles.
• Consequential damages (e.g., loss of earnings due to a cancelled Trip).
• Mechanical breakdowns that are not caused by the Renter's negligence.
